Vitex Natura supplies to various countries. Shipping times vary depending on location and local service provider.

Vitex Natura works together with various logistics companies. In this way we can offer the lowest possible transport costs.

EUROPEAN ORDERS & REST OF THE WORLD 

Deliveries to countries outside the EU are possible through our webshop. The additional shipping costs may vary depending on your location. 

* Please note that the prices of the products do not include duties and taxes. The customs duties (or rates) are determined by the customs of the country of destination and may additionally apply, depending on the purchase amount.

By default, import duties are passed on to the recipient. According to Incoterms, DAP (Delivered At Place). Incoterms is a standard practice in the international transportation of goods and defines the rights and obligations of buyers and sellers.

Article 1. Applicability                                                                                                                                   

These General Terms and Conditions (hereinafter: Terms and Conditions) apply to all offers, orders and agreements of Wholesaler VitexNatura trade under the name Luxury and Beauty.

Accepting an offer or placing an order means that you accept the applicability of these Conditions.

The provisions of these Terms and Conditions can only be deviated from after written notification or written approval by Wholesale VitexNatura, in which case the other provisions remain in full force.

All rights and claims, as stipulated in these Terms and Conditions, and in any further agreements for the benefit of Wholesale VitexNatura, are also stipulated for the benefit of intermediaries and other third parties engaged by Wholesale VitexNatura.

Article 3. Offers / agreements

All offers from Wholesaler VitexNatura are without obligation and Wholesaler VitexNatura expressly reserves the right to change the prices, in particular when this is necessary on the basis of (legal) regulations.

An agreement is only concluded after acceptance of your order by Wholesale VitexNatura. Wholesaler VitexNatura is entitled to refuse orders or to attach certain conditions to the delivery unless explicitly stated otherwise. If an order is not accepted, Wholesale VitexNatura will notify this within ten (10) working days after receipt of the order.

Article 4. Prices and payments

The stated prices for the products and services offered are in Euros, exclusive of VAT, any taxes, and/or other levies unless stated otherwise or agreed in writing.

For orders with the delivery address located outside the Netherlands, the rates of regular mail are used.

Wholesaler VitexNatura offers the following payment option.

Prepayment: You can pay in advance. Your order will then be delivered after your payment has been received at Wholesale VitexNatura. This is a MUST for new customers and unfortunately, we have to apply this.

Article 5. Delivery

If the force majeure lasts longer than 30 days, both Wholesaler VitexNatura and the buyer have the option to dissolve the agreement in writing, after which both parties are released from their obligations towards each other and any payments already made will be refunded. The delivery times stated by Wholesale VitexNatura are only indicative. Exceeding any delivery period does not entitle you to compensation.

The delivery of the products takes place at the place and time when the products are ready for shipment to you.

Wholesale VitexNatura is entitled to fulfill the goods to be delivered in parts. The additional costs of subsequent delivery will be borne by Wholesale VitexNatura.

Article 6. Retention of title

The ownership of the delivered products is only transferred if you have paid all that you owe to Wholesale VitexNatura on the basis of any agreement. The risk with regard to the products is already transferred to you at the time of delivery.

Article 7. Intellectual and industrial property rights

You must fully and unconditionally respect all intellectual and industrial property rights that rest on the products supplied by Wholesale VitexNatura.

Article 8. Complaints and liability

You have the obligation to check on delivery whether the products meet the agreement. If this is not the case, you must contact Wholesale VitexNatura as soon as possible and in any case within two (2) days after delivery, or at least after an observation was reasonably possible, to  info@vitexnatura-wholesale.com.

Since we import products from Southern Europe, Eastern, and Asian countries, minor model and/or color changes may occur.

Article 9. Orders / communication

For misunderstandings, mutilations, delays, or improper transmission of order data and communications as a result of the use of the Internet or any other means of communication in the traffic between you and Wholesale VitexNatura, or between Wholesale VitexNatura and third parties, insofar as it pertains to the relationship between You and Wholesale VitexNatura, Wholesale VitexNatura is not liable, unless and insofar as there may be intent or gross negligence by Wholesale VitexNatura.

Article 10. Personal data

Wholesaler VitexNatura adheres to the Data Protection Act. The information provided is included in a file. Wholesale VitexNatura respects the privacy of all users of its site and ensures that personal information is always treated confidentially. This information will be used to process orders as quickly and easily as possible. The personal data will never be made available to third parties that are not affiliated with Wholesale VitexNatura.

Article 11. Force majeure

Without prejudice to its other rights, in case of force majeure, Wholesale VitexNatura has the right to suspend the execution of your order or to dissolve the agreement without judicial intervention, by notifying you in writing, and this without Wholesale VitexNatura being obliged to pay any compensation unless this would be unacceptable in the given circumstances by standards of reasonableness and fairness.

Force majeure is understood to mean any shortcoming that cannot be attributed to Wholesale VitexNatura because it cannot be blamed on its fault and cannot be attributed to it by law, legal act, or generally accepted beliefs.

Article 12. Miscellaneous

If you state an address in writing to Wholesaler VitexNatura, Wholesaler VitexNatura is entitled to send all orders to that address, unless you indicate in writing to Wholesaler VitexNatura another address to which your orders should be sent.

If Wholesale VitexNatura permits deviations from these Conditions, whether or not tacitly, for a short or longer period, this does not affect its right to demand immediate and strict compliance with these Conditions. You can never assert any right on the basis of the fact that Wholesaler VitexNatura applies these Conditions flexibly.

If one or more of the provisions of these Terms and Conditions or any other agreement with Wholesaler VitexNatura should be in conflict with any applicable legal provision, the relevant provision will lapse and will be replaced by a new legally permissible comparable to be determined by Wholesale VitexNatura determination.

Wholesale VitexNatura is authorized to make use of third parties in the execution of your order (s).

Article 13. Applicable law and competent court

All rights, obligations, offers, orders, and agreements to which these Conditions apply, including these Conditions, are exclusively governed by Dutch law.
All disputes between parties will be submitted exclusively to the competent court in the Netherlands.

Article 14. Reasonable cancellation clause

Vitexnatura will demonstrate what his damage and loss will be if the consumer cancels the agreement (prematurely). A proportion that can be reasonably determined. This takes into account the activities already carried out by VitexNatura, costs incurred such as placing an order, arranging extra personnel, extra production or packaging expenses, or logistics costs.

This reasonably demonstrable loss will be the maximum percentage or amount that Vitexnatura will include in the cancellation clause. A correct percentage/amount that can pass the reasonableness test.

If the consumer does not want to pay this amount in the event of cancellation and the consumer tries to destroy the cancellation clause, VitexNatura will state and prove that this is a reasonable cancellation clause.

When the agreement is terminated (without there being a shortcoming on the part of VitexNatura) and is seen by the customer as unreasonably onerous, then VitexNatura will demonstrate that it concerns a reasonable compensation for loss or lost profit suffered by the user (read: entrepreneur).

Vitexnatura will bring his calculation (or by an accountant) into question from which the (higher) standardized damage follows than the amount to be paid by the consumer that follows from the cancellation clause.

RETURN FROM THE REST OF THE WORLD

Unfortunately, we cannot accept returns from countries other than the European Union at this time. We kindly ask for your understanding.
